– Reports that members of the New York Association of Convenience Stores (NYACS) are extremely happy the PACT act has passed.  Their President James Calvin said “Congress made a sensible choice to have them sold in a controlled environment where there is verifiable compliance with tax, age verification and other laws designed to protect public health." 

 

The Journal - Ogdensburg Mayor William D. Nelson has suggested collecting lost revenues from cigarette sales to non-tribal members on Native American reservations to help fill budget holes. He met with representatives of the Enforce the Law - Collect the Tax Coalition earlier this week. The additional revenue brought in from collecting the tax would most likely have kept Ogdensburg Correctional Facility off of the state's prison closure list, and save hundreds of jobs.

The Buffalo News reports that a state tax department policy of not enforcing tax collections on Indian cigarette sales was officially rescinded by the Paterson administration.

Press Republican – Essex County lawmakers gathered Monday to drum up support for collecting taxes on tobacco products sold at Native American reservations.  The state should first collect taxes from cigarette sales to non-tribal members before it reduces services and programs, Supervisor George Canon (R-Newcomb) said at a rally on the steps of the Old County Courthouse in Elizabethtown.

WKTV – Local lawmakers are calling on Albany to collect the tax on cigarettes sold on Native American reservations. The have now formed a group called the "Enforce the Law - Collect the Tax Coalition". The law dates back to 1994, allowing states to collect tax on cigarette sales to non-Native Americans. The law has been enacted since 2006, but rarely ever is enforced.

 

NACS Online reports that Governor Paterson lifted a taxation policy which bars the state from taxing Native cigarette sales. To give his proposal substance, Governor Paterson proposed a new policy which moves the collection of taxes on Native cigarette sales from the retailer to the wholesaler level.

 

The New York State Department of Taxation and Finance issues a press release stating that Department has proposed regulations that would limit the quantity of tax-free cigarettes that may legally be supplied to the Indian nations or tribes.

 

WSYR reports that the New York State Tax Department will issue regulations to collect taxes on cigarettes sold by Indian retailers.
