In June of 2010, the State Legislature and Governor Paterson enacted a law ending a long-standing loophole in the state's cigarette excise tax system – a loophole that has allowed tribal smoke shops to sell untaxed and unstamped cigarettes to non-tribal members without limit. The 2010 law directed the New York Department of Tax and Finance to begin collecting these taxes – and restoring fairness in the system – by September 1, 2010.
Unfortunately, certain tribal organizations filed lawsuits in state and federal courts trying to block this law from going into effect.
New York needs to continue moving forward in defense of this new tax collection system - for the law-abiding retailers who play by the rules and hard-working taxpayers who shoulder an increasingly heavy burden. With the state’s on-going budget problems, let's finish the job. It's the right thing to do - and the right time to do it.
